ACCEPTABLE USE POLICY

  1. INTRODUCTION

    Thank you for using Financial Basket Capital Pvt. Ltd. (“ETF Junction,” “we,” “us,” or “our”).

    This Acceptable Use Policy (“AUP”) forms an integral part of our Terms and Conditions and applies to all visitors, registered users, contributors, Influencers, and other persons who access or use our website, mobile application, social media channels, interactive features, and other platforms or services operated by or connected with ETF Junction (collectively, the “Platform”).

    This AUP sets out the standards for lawful, responsible, and appropriate use of the Platform. By accessing or using the Platform, you agree to comply with this AUP, our Terms and Conditions, our Disclosure, and all applicable laws and regulations.

    In simple terms: Do not misuse the Platform, submit illegal or misleading content, impersonate others, make unauthorized investment-related claims or promotions, manipulate financial information or discussions, or interfere with the security or operation of the Platform.

    ETF Junction provides access to ETF-related information, tools, educational resources, and ETF baskets curated by third-party specialists. Nothing in this AUP changes ETF Junction’s role as a technology platform and intermediary as described in our Terms and Conditions and Disclosure.

  2. DEFINITIONS

    For purposes of this AUP:

    “Platform” means the ETF Junction website, mobile applications, social media channels, interactive features, and related services.

    “User Contribution” means any content, information, comments, posts, reviews, portfolio-related information, or other material submitted, posted, or shared by a user through the Platform.

    “Platform Content” means content, data, text, graphics, research, analysis, tools, software, videos, and other materials provided by or on behalf of ETF Junction.

    “Influencer” means a user approved by ETF Junction to participate in its Influencer program.

    “Third-Party Specialist” means an external professional or entity whose ETF baskets, strategies, or related information may be made available through the Platform.

    “Financial Promotion” means content or communication intended to promote, market, solicit, or encourage investment in a financial product, security, investment strategy, or financial service.

  3. PROHIBITED USES AND CODE OF CONDUCT

    3.1 Lawful and Responsible Use

    You may use the Platform only for lawful purposes and in accordance with this AUP, our Terms and Conditions, our Disclosure, and other applicable policies.

    You agree not to use the Platform:

    3.1.1 In any manner that violates any applicable law, regulation, regulatory requirement, or order of a competent authority.

    3.1.2 To exploit, harm, or attempt to harm minors, including by requesting, collecting, or sharing their personal information or exposing them to inappropriate content.

    3.1.3 To send or distribute unsolicited advertising, promotional material, spam, chain messages, or other unauthorized solicitations.

    3.1.4 To impersonate ETF Junction, its employees, representatives, partners, Influencers, Third-Party Specialists, or any other person or organization, or misrepresent your identity, affiliation, or authority.

    3.1.5 To engage in conduct that restricts, interferes with, or materially affects another person's use of the Platform or that may harm ETF Junction, its users, partners, or third parties.

    3.2 Platform and Security Restrictions

    You also agree not to:

    3.2.1 Use the Platform in a manner that could disable, overburden, damage, impair, or materially interfere with its operation or another user's access to or use of the Platform.

    3.2.2 Use robots, spiders, crawlers, scrapers, automated tools, bots, or similar technologies to access, monitor, copy, extract, or collect Platform Content or data unless expressly authorized by ETF Junction in writing.

    3.2.3 Systematically copy, reproduce, extract, monitor, or collect Platform Content, ETF-related data, research, analysis, rankings, portfolio information, or other materials for purposes not expressly authorized by ETF Junction.

    3.2.4 Introduce or transmit viruses, Trojan horses, worms, logic bombs, malware, ransomware, spyware, or other malicious or technologically harmful material.

    3.2.5 Attempt to gain unauthorized access to the Platform, accounts, servers, databases, systems, networks, or infrastructure connected with the Platform.

    3.2.6 Attempt to bypass, disable, defeat, or interfere with security, authentication, access-control, or technological protection measures.

    3.2.7 Conduct or attempt to conduct denial-of-service (“DoS”), distributed denial-of-service (“DDoS”), or similar attacks.

    3.2.8 Otherwise attempt to compromise the security, availability, integrity, or proper functioning of the Platform.

  4. USER CONTRIBUTIONS

    4.1 The Platform and our social media channels may contain message boards, forums, profiles, comment sections, chat features, or other interactive features that allow users to post, submit, publish, display, or transmit content or materials (“User Contributions”).

    4.2 You are solely responsible for the User Contributions you submit and must ensure that they are lawful, accurate, and not misleading.

    4.3 User Contributions may include comments, opinions, investment-related discussions, educational material, reviews, or portfolio-related information. User Contributions represent the views of their respective authors and do not automatically represent the views or recommendations of ETF Junction.

    4.4 You must not use User Contributions to provide or promote unauthorized investment advice, make guaranteed or misleading return claims, manipulate investment-related discussions, or misrepresent the performance, risk, or characteristics of any ETF, investment strategy, or financial product.

    4.5 Unless otherwise stated in our Terms and Conditions or applicable policy, User Contributions may be treated as non-confidential and non-proprietary.

    By submitting a User Contribution, you grant ETF Junction a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and modify that User Contribution only to the extent reasonably necessary to operate, maintain, moderate, improve, or promote the Platform, subject to applicable law and your account or privacy settings.

    4.6 By submitting a User Contribution, you represent and warrant that:

    4.6.1 You own or control the rights necessary to submit the User Contribution and grant the rights described above.

    4.6.2 Your User Contribution complies with this AUP, our Terms and Conditions, and applicable laws and regulations.

    4.6.3 Your User Contribution does not infringe the intellectual property, privacy, publicity, contractual, or other rights of another person or entity.

    4.6.4 Any investment-related information, performance data, claims, or representations contained in your User Contribution are accurate to the best of your knowledge and are not presented in a false or misleading manner.

    4.6.5 You have obtained all permissions or consents required for any personal information, images, videos, or third-party material included in your User Contribution.

    4.7 ETF Junction does not endorse or guarantee the accuracy, reliability, completeness, or suitability of User Contributions posted by users or third parties.

  5. CONTENT STANDARDS

    These Content Standards apply to all User Contributions and Interactive Services. User Contributions must comply with applicable laws and must not:

    5.1 Contain defamatory, obscene, abusive, threatening, harassing, hateful, violent, discriminatory, or otherwise unlawful material.

    5.2 Promote or encourage illegal activities, violence, fraud, market abuse, or other unlawful conduct.

    5.3 Infringe any copyright, trademark, patent, trade secret, or other intellectual property or proprietary right.

    5.4 Violate the privacy, publicity, contractual, or other legal rights of another person or entity.

    5.5 Include images, videos, personal information, or other material relating to another individual without the required authorization or consent.

    5.6 Contain information that is knowingly false, misleading, deceptive, fabricated, or reasonably likely to deceive users.

    5.7 Make unsupported or misleading claims regarding investment returns, past performance, future performance, risk, guaranteed profits, or investment suitability.

    5.8 Falsify or manipulate historical or current performance data, portfolio holdings, investment results, testimonials, reviews, or other financial information.

    5.9 Attempt to manipulate users’ perceptions of an ETF, investment strategy, financial product, Influencer, Third-Party Specialist, or other market participant through false or misleading information.

    5.10 Impersonate ETF Junction, a SEBI-registered professional, Influencer, Third-Party Specialist, financial institution, or other individual or organization, or falsely claim an affiliation with them.

    5.11 Promote unauthorized investment services, financial products, securities, schemes, or other commercial offerings in violation of applicable laws or regulatory requirements.

    5.12 Contain unauthorized advertisements, spam, promotional campaigns, referral schemes, or commercial solicitations.

    5.13 Attempt to circumvent Platform rules, moderation measures, account restrictions, or other safeguards.

    5.14 Give the impression that content originates from, is reviewed, endorsed, sponsored, or approved by ETF Junction or its partners when that is not the case.

    5.15 Intentionally manipulate, disrupt, or undermine legitimate discussions, reviews, rankings, or information available through the Platform.

    5.16 No Investment Advice

    User Contributions, discussions, portfolios, opinions, and other user-generated content do not constitute investment advice or recommendations from ETF Junction.

    Users must not represent such content as advice provided or endorsed by ETF Junction. Users should independently evaluate investment information and seek professional financial advice where appropriate.

  6. MONITORING, ENFORCEMENT, AND TERMINATION

    6.1 Monitoring

    ETF Junction may, but is not obligated to, monitor or review User Contributions and activities on the Platform for compliance with this AUP, our Terms and Conditions, and applicable law.

    We do not undertake to review every User Contribution before publication and cannot guarantee that all prohibited, inaccurate, misleading, or objectionable content will be identified or removed immediately.

    6.2 Consequences of Violations

    Depending on the nature and severity of a violation, ETF Junction may:

    • Issue a warning;
    • Remove, restrict, or disable access to content;
    • Restrict access to specific Platform features;
    • Suspend or terminate an Account;
    • Restrict or terminate access to the Platform; and/or
    • Take appropriate legal or regulatory action.

    Serious or repeated violations may result in immediate suspension or termination without prior notice, where permitted by applicable law.

    6.3 Our Rights

    ETF Junction reserves the right to take any action reasonably necessary to:

    6.3.1 Protect ETF Junction, its users, partners, third parties, and the integrity and security of the Platform.

    6.3.2 Address impersonation, fraud, misleading investment claims, unauthorized financial promotions, market-related manipulation, security violations, or other misuse.

    6.3.3 Preserve or disclose information where reasonably necessary to comply with applicable law, legal process, regulatory requirements, or lawful requests from competent authorities.

    6.3.4 Refer suspected illegal, fraudulent, abusive, or security-related activity to law enforcement, regulators, or other competent authorities where required or permitted by law.

    6.4 Cooperation With Authorities

    We may cooperate with law enforcement agencies, regulators, courts, government authorities, or other competent bodies where required or legally permitted, including in connection with investigations involving illegal activity, fraud, cybersecurity incidents, impersonation, intellectual property violations, or misuse of investment-related information.

  7. REPORTING VIOLATIONS

    If you believe that content or activity on the Platform:

    • Violates this AUP or our Terms and Conditions;
    • Contains misleading or fraudulent investment-related information;
    • Involves impersonation;
    • Infringes intellectual property or privacy rights;
    • Involves unauthorized financial promotions or solicitation; or
    • Creates a security, fraud, or other serious Platform-related concern,

    Where possible, please include the relevant content, account, page, URL, description of the issue, and any supporting information.

    ETF Junction may review reports and take appropriate action based on the circumstances and applicable law.

  8. CHANGES TO THIS ACCEPTABLE USE POLICY

    We may update this AUP from time to time to reflect changes to the Platform, applicable laws, regulatory requirements, or our practices.

    Any updated version will be posted on the Platform and will become effective as stated in the updated policy. Your continued use of the Platform after the updated AUP becomes effective constitutes your acceptance of the revised policy.

    If you do not agree with the updated AUP, you must stop accessing and using the Platform.
